Joe Jackson refiles wrongful death suit

Michael Jackson’s father Joe has refilled his wrongful death lawsuit in California following a federal judge’s claim that the case had to be heard in court.

Jackson originally filed the suit on August 10 against his son’s personal physician Dr. Conrad Murray in a federal court, accusing the doctor of administering a fatal dose of anaesthetic Propofol to Michael in June 2009.

Jackson claims that he was a dependent of his son at the time of the death and is therefore eligible to file w wrongful death suit.

U.S. District Judge John F. Walter ruled last month (November 10) that some of the issues had to be handled in a state court. So, Jackson's lawyer has refiled the documents at Los Angeles County Superior Court last night (November 30) according to TMZ.com.

Jackson is seeking damages  from  $10 million (£6.7 million) and $500 million (£333.3 million) in the suit for emotional distress, loss of support and "loss of comfort, aid, society and companionship".

Dr. Murray has pleaded not guilty to involuntary manslaughter in Michael Jackson’s death and will stand trial in January 2011.
